Terms of Service

Translation This is a translation of our German general terms and conditions (Allgemeine Geschäftsbedingungen), provided for your convenience. The German version is the legally binding one; if the two texts differ, the German text prevails. You can read it at AGB (German).

for the use of Fylgra · Last updated: 16 October 2026

1. Scope and provider

  1. These General Terms and Conditions (“Terms”) apply to the use of the Discord bot “Fylgra”, the associated web dashboard at fylgra.com and the functions and paid plans provided through them (together “Fylgra” or the “Service”).
  2. The provider and contractual partner is the operator named in the imprint (German) of fylgra.com (“Provider”).
  3. These Terms apply both to free functions and to paid services, in particular the “Fylgra Pro” plan.
  4. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. A trader is a natural or legal person or a partnership with legal capacity who, when concluding the contract, acts in the exercise of their trade, business or profession.
  5. Individual agreements and the information on services, prices, contract term and billing displayed when ordering a paid plan take precedence over these Terms to the extent that they deviate from them.
  6. Deviating terms of the user apply only if the Provider has expressly agreed to their validity.

2. Subject matter of the Service

  1. Fylgra is an administration and automation tool, in particular for Discord servers and related community functions.
  2. Among other things, the Service may provide functions for managing server structures, roles, polls, events, scheduled posts, tickets, giveaways and further community functions.
  3. The type and scope of the available functions depend on the plan used and on the service description applicable at the relevant time.
  4. Certain functions require services or interfaces of third parties, in particular Discord and, where applicable, Twitch. These services are operated by independent third-party providers. In particular, Fylgra is not affiliated with Discord Inc. or Twitch unless expressly stated otherwise.
  5. The Provider owes solely the provision of the agreed Fylgra functions. Services of the respective third-party providers are not part of the scope of services owed by Fylgra.

3. Registration and conclusion of the contract

  1. Using Fylgra may require signing in with a supported user account of a third-party provider, in particular Discord.
  2. The free usage contract is concluded as soon as the user signs in to Fylgra for the first time or invites the bot to a Discord server and the Service is activated for them.
  3. A contract for Fylgra Pro or another paid service is concluded when the user places a binding order for the respective plan through the ordering process provided for this purpose and the Provider accepts the order or activates the service.
  4. Before a paid order is placed, the price, the billing period, any minimum term, the conditions of a trial period and the cancellation conditions in particular are displayed.
  5. The contractual partner for a paid plan is the natural or legal person who places the order under the account used.
  6. If Fylgra is set up for a Discord server or another account that does not belong to the user themselves, the user warrants that they hold the necessary permissions to do so.
  7. There is no entitlement to the conclusion of a usage contract or to the activation of certain functions.

4. Requirements for use

  1. Using Fylgra requires a valid account with the required third-party providers, in particular Discord.
  2. The user is responsible for complying with the terms of use of the third-party providers they use.
  3. Fylgra is generally intended for persons aged 16 and over.
  4. Minors may conclude paid contracts only insofar as they are legally entitled to do so or the required consent of their legal guardians has been given.
  5. To add the bot to a Discord server or to manage a server via Fylgra, the user must hold the rights and permissions required for this.
  6. The user shall ensure that the information they provide or that is transmitted via connected services is accurate.

5. User account and access data

  1. The user is obliged to protect access data and other security-relevant information against access by unauthorised third parties.
  2. If the user discovers or suspects that their account is being used without authorisation, they must take suitable measures to secure their account and, where necessary, inform the Provider.
  3. Actions taken via a properly authenticated user account are, as a rule, attributed to the account concerned. Mandatory statutory provisions remain unaffected.

6. Obligations of the user

  1. Fylgra may only be used within the scope of the applicable laws, these Terms and the terms of the connected third-party providers.
  2. In particular, it is prohibited to use Fylgra in order to
    • create, store or distribute unlawful content,
    • infringe the rights of third parties, in particular copyrights, trademark rights, data protection rights or personality rights,
    • distribute insulting content, content inciting hatred or other unlawful content,
    • distribute malware or comparable harmful content,
    • gain unauthorised access to systems, accounts or data of third parties,
    • circumvent protective measures, access restrictions or technical limits of Fylgra,
    • query or load the Service automatically in a way that may impair its proper operation,
    • use Fylgra for spam or other abusive activities.
  3. The user is responsible for the settings they make and for the actions they cause via Fylgra.
  4. In the event of breaches of these Terms or of applicable law, the Provider may take appropriate measures. These may include, in particular, the removal of affected content, the restriction of individual functions or a temporary suspension of access.
  5. The type and extent of the measure depend on the severity and duration of the breach and on the legitimate interests of both parties. Where appropriate, the user will be given the opportunity to remedy the breach before a permanent suspension.
  6. The right to terminate for good cause without notice remains unaffected.

7. User content

  1. The respective user generally remains responsible for texts, images, files, settings, dates, posts and other content that a user provides via Fylgra.
  2. The Provider does not adopt user content as its own and, as a rule, does not review it before it is processed or published.
  3. The user warrants that they hold the necessary rights to the content they provide and that its use via Fylgra does not infringe the rights of third parties.
  4. For the term of the usage contract, the user grants the Provider the non-exclusive rights of use to the content they provide that are necessary to perform the Service.
  5. This grant of rights covers only the use necessary to provide the functions requested by the user. This includes in particular storing, technically reproducing, processing, formatting and transmitting content and publishing it via the services selected by the user, for example Discord or Twitch.
  6. No use of user content beyond this takes place on the basis of this grant of rights.
  7. After the contract ends, content stored by the Provider is deleted in accordance with the privacy policy and existing statutory retention obligations.

8. Giveaways

  1. Fylgra may provide functions for the technical conduct of giveaways, in particular in connection with Twitch or Discord.
  2. For this purpose, Fylgra provides technical tools only. The organiser of the respective giveaway is the user who creates the giveaway or has it conducted.
  3. The Provider does not become a party to any legal relationship arising between the user and participants or winners.
  4. The user is in particular responsible themselves for
    • the selection, procurement and provision of the prizes offered,
    • drawing up and complying with suitable conditions of participation,
    • complying with the requirements of the platform used,
    • complying with statutory requirements,
    • communicating with participants and winners,
    • shipping or otherwise handing over a prize.
  5. If the user authorises further persons to manage a giveaway, it is the user’s responsibility to grant these persons only the permissions they need.
  6. Determining a winner technically via Fylgra does not give rise to any claim against the Provider for the provision or handover of a prize.
  7. Where a function enables automatic participation on the basis of chat activity, the organiser is responsible for informing participants appropriately about their participation and about any available means of objection.

9. Free functions and Fylgra Pro

  1. Fylgra may offer both free and paid functions.
  2. Which functions can be used free of charge and which functions form part of Fylgra Pro or another paid plan is set out in the current service description.
  3. Costs arise only for services that are expressly marked as subject to a charge and that the user has ordered accordingly.
  4. The price and the respective billing period are displayed to the user before the order is completed.
  5. Unless expressly stated otherwise, all prices displayed to consumers are total prices including the statutory value added tax.
  6. Payment is made using the payment methods offered in the ordering process.
  7. The user is obliged to keep the information required for payment up to date and to ensure that payments due can be made using the chosen payment method.
  8. If a payment due fails, the Provider may, after appropriate prior notice, restrict access to paid functions until the outstanding amount has been settled. The statutory rights of both parties remain unaffected.

10. Free trial of Fylgra Pro

  1. When Fylgra Pro is booked for the first time, the user may be granted a free trial period of 14 days.
  2. Whether a trial period is granted and which conditions apply to it is displayed before the order is completed.
  3. Where a 14-day trial period is offered, it begins when the Pro subscription is taken out. No fee is charged for the use of Fylgra Pro during the trial period.
  4. As a rule, the free trial period can be used only once per user. There is no entitlement to a trial period being granted again.
  5. If the Pro subscription is not cancelled before the end of the trial period, it is then automatically continued on a paid basis on the conditions displayed when the order was completed.
  6. Before the subscription is taken out, it is displayed which price is charged after the end of the trial period and for which billing period it is charged.
  7. The free trial period is a voluntary contractual service of the Provider and exists independently of any statutory right of withdrawal.

10a. Refer friends

  1. The Provider may offer a referral programme called “Refer friends” (“Freunde werben”). Participation is voluntary and free of charge. A claim to participate, to the continuation of the programme or to a reward exists only in accordance with this section. The Provider decides whether, from when and for whom the programme is offered; in particular, it may initially offer it only to individual accounts it has enabled (test mode).
  2. Participation as a referrer. Only a user who holds a Fylgra account and is, at the same time, the owner on Discord of at least one server on which Fylgra is active may create a personal referral link. Accounts with operator rights are excluded, as are accounts restricted under section 6. Each user has no more than one active referral link. The link is personal and may not be sold, exchanged or offered for consideration.
  3. Referred person. A referred person is someone who comes to Fylgra via a referral link, expressly accepts the referral on the corresponding page and then signs in to Fylgra with their Discord account for the first time. Before accepting, they must not have signed in to Fylgra, including as a moderator or administrator of someone else’s server, and must not have held a Fylgra account. A Fylgra account that is only created after accepting, because the person adds Fylgra to a server of their own before signing in, does not prevent this. Only the first referral accepted counts. It is effective for 30 days from acceptance and only if the sign-in takes place in the same browser in which the referral was accepted. Referring oneself, for example via another Discord account, does not count as participation.
  4. Valid referral. A referral is valid if all of the following requirements are met within 60 days of the referred person’s sign-in:
    1. The referred person is the owner on Discord of a server that belongs to their Fylgra account and to which Fylgra was added only after the referral was accepted. A server that has already led to a referral or is under review does not count, not even after Fylgra has been removed and added again.
    2. Fylgra has been active on that server without interruption for at least 4 days. If Fylgra is removed and added again, this period starts again.
    3. Messages have been posted on the server on at least 5 different days after the day Fylgra was added.
    4. A person has set up or switched on at least one Fylgra module on the server or saved its settings. Modules created automatically do not count.
    5. The referred person has used the Fylgra dashboard on at least 2 different days.
    6. Neither the server nor any of the accounts involved is restricted.
If the requirements are not met when the period ends, no reward arises.
  5. Reward. For each valid referral, the referrer and the referred person each receive one week (7 days) of Fylgra Pro for their Fylgra account. The referrer receives no more than 13 weeks per calendar year. What counts is the year in which the referral became valid, in German time. Valid referrals above this limit are not rewarded and are not carried over to the following year. The referred person receives their week only once. This applies per person and per Fylgra account: an account that takes over a server for which such a week has already been granted does not receive another one.
  6. No monetary benefit. The reward is a free additional service. It is not paid out in money, not refunded and not set off against charges, including as a discount. It is not transferable and remains with the account for which it was granted. This also applies if a server changes owner.
  7. Redemption and saving up. A reward is redeemed automatically, usually during the night after it has been credited. Several weeks are redeemed together. Any running time-limited Pro period, for example from a key, is extended accordingly. If the account has a paid subscription (via Stripe or Discord) or a plan granted by the Provider that is unlimited in time or higher, the reward is saved up and redeemed after it ends. A reward is also saved up for as long as redemption is not possible for other reasons, for example because the account currently has no server of its own with Fylgra.
  8. Purchase during a running week. If a subscription is taken out on the website during a running week, any remaining time of at least 48 hours is taken into account as a free period at the start of the subscription, as shown in the ordering process. A shorter remaining time, and the remaining time in the case of a purchase via Discord, is credited as whole days to the saved-up balance and redeemed after the subscription ends; a partial day is dropped.
  9. Expiry. Saved-up rewards expire 12 calendar months after they were credited. This period is suspended while a paid subscription is running, while the account is restricted, or while redemption fails for reasons outside the user’s control, in particular because a plan granted by the Provider is unlimited in time, higher or equivalent, or a plan change is scheduled. It is not suspended merely because the account has no server of its own with Fylgra; after a termination of the programme has taken effect (number 13), it is suspended in that case too. The expiry date is shown in the profile. The balance lapses when the Fylgra account is deleted in accordance with the privacy policy. A balance does not extend any deletion period.
  10. End of a week. When a week ends, the plan that would apply without it applies again. The same consequences apply as at the end of any other time-limited Pro period: functions, modules and servers that go beyond the scope of that plan are locked until the account changes to Fylgra Pro again. The associated data is retained in accordance with the privacy policy. The reward does not give rise to any costs.
  11. Review. Every referral is checked automatically for signs of misuse. If such signs are found, the Provider reviews the referral personally. No reward is credited while the review is ongoing. A review in itself is not a rejection. If the Provider does not decide within 30 days of the start of the review, the referral is not rewarded. The Provider does not disclose which signs are checked in detail. The privacy policy describes which data is processed for this purpose. The user may send objections to a decision to the Provider by e-mail.
  12. Misuse and obligations when referring. In particular, it is prohibited
    • to refer oneself or people from one’s own circle via additional Discord accounts merely to obtain a reward,
    • to operate servers only for appearance’s sake or to bring about the requirements through automated or coordinated activity,
    • to distribute referral links through unsolicited messages (spam), mass direct messages or otherwise in breach of statutory provisions or Discord’s rules,
    • to make misleading statements about Fylgra or the reward.
Anyone who shares their link publicly, for example in posts, videos or streams, makes it clear that they receive a reward for valid referrals. In the event of misuse or a well-founded suspicion, the Provider may withdraw a reward, including after the fact. Rewards not yet redeemed then lapse, and a running week may be ended early. The Provider does not charge for Pro time already used. The Provider may also block the referral link. A new link is then available only with the Provider’s consent. Further measures under section 6 remain unaffected.
  13. Changes and termination. The Provider may change the programme, the reward and the requirements for the future or end the programme. It announces this at least 30 days in advance in the dashboard or on fylgra.com. For good cause, in particular in the event of misuse, changed requirements by Discord or for legal reasons, this is also possible at short notice. Rewards that became valid or were saved up before the change takes effect remain redeemable until they expire. Referrals in which the referred person signed in before the change takes effect can still become valid within their period under the previous conditions.
  14. The Provider does not guarantee that a referral is technically recorded, for example if the browser blocks cookies, the referral was not accepted or the sign-in takes place in a different browser. Otherwise, section 16 applies.
  15. Section 11d of the privacy policy describes which personal data is processed for the programme.

11. Term and cancellation

  1. The general usage contract for Fylgra is concluded for an indefinite period.
  2. The user may stop using the free Service at any time.
  3. Merely removing the Discord bot from an individual server does not automatically lead to the deletion of the Fylgra account or to the cancellation of an existing paid subscription.
  4. The term, renewal and cancellation conditions displayed during the ordering process apply to Fylgra Pro.
  5. Where Fylgra Pro is offered for an indefinite period with recurring billing, the subscription can be cancelled with effect from the point in time stated in the ordering process.
  6. As a rule, a cancellation ends the paid Pro functions at the end of the period for which remuneration is already owed or has been paid, unless the user is entitled by law to end it earlier.
  7. During a free trial period, the Pro subscription can be cancelled at any time with effect from the end of the trial period. If it is cancelled in time, no fee for Fylgra Pro becomes due afterwards.
  8. For paid continuing obligations concluded online, consumers can use the cancellation function (German) provided on the website.
  9. The right of both parties to terminate for good cause without notice remains unaffected.
  10. The Provider may terminate an exclusively free usage contract with a notice period of 14 days.
  11. The Provider may terminate a paid subscription with ordinary notice with effect from the end of the current contract or billing period. Services already owed continue to be provided until the date of termination, unless there is good cause for immediate termination.
  12. After the contract ends, access to the functions affected by it ends. The deletion of personal data is governed by the privacy policy and statutory retention obligations.

12. Right of withdrawal for consumers

  1. Consumers may have a statutory right of withdrawal when concluding a distance contract.
  2. Information on the right of withdrawal, the withdrawal period and how to exercise the right of withdrawal is provided to consumers separately in the withdrawal instructions (German).
  3. A free trial period does not constitute an extension of a statutory right of withdrawal.
  4. The statutory rights of the consumer remain unaffected by the provisions on the trial period and on contractual cancellation.

13. Availability, maintenance and changes to the Service

  1. The Provider endeavours to provide Fylgra reliably and with as few interruptions as possible. However, availability at all times and completely free of disruption is not agreed, unless a specific availability has been expressly promised.
  2. Temporary restrictions may occur in particular due to necessary maintenance and security measures, technical faults and faults at or changes by third-party providers.
  3. The Provider may develop Fylgra further technically and change functions, provided that there is a valid reason for this.
  4. Valid reasons may in particular be:
    • changes in the technical requirements or infrastructure,
    • changes to interfaces or requirements of connected third-party providers,
    • security requirements or measures to combat abuse,
    • changes in statutory or regulatory requirements,
    • adaptation to technical progress,
    • improving stability, compatibility or ease of use,
    • discontinuing technically outdated functions, provided that the purpose of the contract is not unreasonably impaired as a result.
  5. Where the statutory provisions on digital products apply to consumers, changes to the Service are made only under the statutory conditions applicable to them.
  6. In particular, a change within the meaning of the statutory provisions does not result in any additional costs for the consumer. The user is informed clearly and comprehensibly about relevant changes.
  7. If a change impairs a consumer’s ability to access or use a digital product more than only insignificantly, the information required by law is made available in good time on a durable medium. Statutory termination rights of the consumer remain unaffected.
  8. Changes to free functions or their discontinuation are permissible, provided that the legitimate interests of users are appropriately taken into account and no mandatory statutory provisions stand in the way.

14. Third-party providers and external platforms

  1. Using certain Fylgra functions depends on services of third parties, in particular Discord and, where applicable, Twitch.
  2. The Provider has no influence on the continued availability, technical design, interfaces, terms of use or business decisions of these third-party providers.
  3. Changes to, restrictions of or the discontinuation of a third-party interface may mean that individual Fylgra functions can temporarily or permanently no longer be offered, or only in a modified form.
  4. Where such a change affects a paid service, the statutory rights of the user and the provisions of these Terms on changes to the Service apply.
  5. The user is responsible themselves for their contractual relationship with the respective third-party providers.

15. Statutory rights for digital products

  1. Where the statutory provisions on consumer contracts for digital products apply, consumers have the statutory rights in the event of a provision that is not in conformity with the contract.
  2. During the period relevant by law, the Provider provides the updates necessary to maintain conformity with the contract, including necessary security updates, insofar as this is required by law.
  3. The statutory rights of the consumer in respect of digital services that are not provided or are provided defectively are not restricted by these Terms.

16. Liability

  1. The liability of the Provider is governed by the statutory provisions unless otherwise provided below.
  2. The Provider’s liability for damage resulting from a slightly negligent breach of non-essential contractual obligations is excluded.
  3. In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the damage that was foreseeable when the contract was concluded and is typical for the contract.
  4. Essential contractual obligations are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the user may regularly rely.
  5. The above limitations of liability do not apply
    • in the event of intent or gross negligence,
    • to damage resulting from injury to life, body or health,
    • in the case of expressly assumed guarantees,
    • in the case of fraudulently concealed defects,
    • to claims under the German Product Liability Act (Produkthaftungsgesetz), or
    • in other cases of mandatory statutory liability.
  6. The above provisions on liability apply accordingly in favour of the Provider’s legal representatives, employees and vicarious agents.
  7. The Provider bears no responsibility for faults, restrictions or outages of Discord, Twitch or other third-party providers that lie outside the Provider’s sphere of responsibility and influence. Statutory claims arising from a breach of duty for which the Provider is responsible remain unaffected.
  8. The user is responsible for backing up themselves, as far as reasonable, content and data that are available to them exclusively or additionally via other services and whose loss would have significant consequences for them.
  9. No guarantee is given for any particular economic, organisational or other success through the use of Fylgra.

17. Rights in Fylgra

  1. All rights in Fylgra, in particular in the software developed by the Provider, the source code, the graphics, texts, database structures and other proprietary components of the Service, remain with the Provider or the respective rights holder.
  2. Rights of third parties, in particular in software libraries, trademarks and external services, remain unaffected.
  3. For the term of the usage contract, the user receives a non-exclusive and non-transferable right to use Fylgra to the extent provided for in the contract.
  4. Any further reproduction, modification, distribution, making available to the public or other exploitation of components of the Service is permitted only insofar as it is permitted by law or allowed by the respective rights holder.
  5. Mandatory statutory rights of use remain unaffected.

18. Changes to these Terms

  1. The Provider may change these Terms if there is an objective reason for doing so and the change does not unreasonably shift the contractual balance to the detriment of the user.
  2. An objective reason may exist in particular on account of
    • a change in the legal situation or in supreme court case law,
    • new regulatory requirements,
    • necessary adjustments to new or changed functions,
    • technical developments or changes to connected platforms,
    • closing gaps in the provisions that are identified subsequently.
  3. The user is informed of material changes in good time before they take effect.
  4. Where the user’s express consent is required by law for a change, the change becomes part of the contract only with this consent.
  5. Changes to the agreed prices or to the essential scope of services of an existing paid subscription are not made solely on the basis of this section.
  6. For changes to digital products vis-à-vis consumers, the mandatory statutory provisions apply in addition.

19. Data protection

  1. Information on the type, scope and purposes of the processing of personal data is contained in the current privacy policy at fylgra.com.
  2. Where the user processes personal data of other persons when using Fylgra, they are responsible for ensuring that there is a sufficient legal basis under data protection law for this.
  3. Where the Provider processes personal data exclusively on behalf of a user and the statutory requirements for this are met, supplementary data protection agreements may be necessary.

20. Final provisions

  1. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
  2. Vis-à-vis consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state in which the consumer has their habitual residence.
  3. For traders, the place of jurisdiction for disputes arising from or in connection with the contractual relationship is, to the extent legally permissible, the Provider’s place of business.
  4. For consumers, the statutory places of jurisdiction apply.
  5. Should a provision of these Terms be or become invalid in whole or in part, the remaining provisions remain unaffected. The statutory provisions apply in place of the invalid provision.
  6. The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless there is a statutory obligation to participate.
